What Are Terrorism Offences?
The Terrorism Act 2000 states that:
(1) Terrorism “means the use or threat of action where—
(a) The action falls within subsection (2)
(b) The use or threat is designed to influence the government or an international governmental organisation or to intimidate the public or a section of the public, and
(c) The use or threat is made for the purpose of advancing a political, religious, racial or ideological cause
(2) Action falls within this subsection if it—
(a) Involves serious violence against a person
(b) Involves serious damage to property
(c) Endangers a person’s life, other than that of the person committing the action
(d) Creates a serious risk to the health or safety of the public or a section of the public, or
(e) Is designed seriously to interfere with or seriously to disrupt an electronic system
(3) The use or threat of action falling within subsection (2) which involves the use of firearms or explosives is terrorism whether or not subsection (1)(b) is satisfied.
In addition to the above, supporting a proscribed organisation is also a criminal offence. ‘Support’ can be something as minor as holding a placard with the name of the organisation written on it.
There are a number of other terrorism-related acts which create further offences, including:
- Producing terrorist publications
- Disseminating terrorist publications
- Giving or receiving terrorism training
- Funding terrorism, to include raising or receiving money and money laundering
- Membership of a proscribed organisation
- Watching terrorist material online

Defence To Terrorism Charges
Terrorism charges are wide-ranging, meaning that there are a number of potential defences. These include:
- Mistaken identity, where the police have arrested the wrong person
- The action you are accused of does not relate to terrorism
- Lack of participation, for example, if the offence relates to supporting terror activities or a proscribed group
- You had a legitimate purpose for the action you took that was not related to terrorism
- You did not have the intention required for the offence, for example, you did not intend your conduct to support a proscribed group
Contacting terrorism offence solicitors promptly is essential in giving you the strongest possible defence. If you would like us to represent you, we will go through any evidence against you in detail and establish exactly what happened. We can then work to put together a strategy to defend you, including obtaining evidence in support of your case.
