Is Fraud By False Representation A Criminal Offence?
Fraud by false representation is a criminal offence under the Fraud Act 2006. It occurs when:
An individual or business:
- Dishonestly provides information;
- Acknowledges that the representation is or could be inaccurate or deceptive; and
- Has the intention of securing personal gain, inducing a loss for another party, or subjecting another party to the risk of financial detriment
Examples Of Fraud By False Representation
Common examples of fraud by false representation include:
- Providing false information to an organisation, such as a mortgage lender or a credit card company
- Using a credit card that belongs to someone else
- Issuing a bill for work that has not been done
- Claiming expenses that have not been incurred
- Selling an item that belongs to someone else
- Selling a defective item but claiming it is in good condition
Sentences For Fraud By False Representation
The level of sentence for fraud by false representation will depend on several issues, including:
- The amount of financial gain obtained
- The length of time the fraud continued for
- The level of planning undertaken
- The impact of the offence on a victim
- Attempts to conceal the offence
- Whether the perpetrator was in a position of trust
Sentencing will generally include a fine, and the courts can also impose a prison sentence of up to ten years. The level of culpability will also be taken into account, for example, whether the offender had a minor role in the fraud or whether they took a leading role or pressured others to take part.
It is also open to the court to make a community service order or suspend a sentence. A confiscation order can be issued under the Proceeds of Crime Act 2002, requiring the repayment of any financial benefit obtained as a result of the fraud.
“From the first call with Abdul, I felt supported—he explained everything clearly and with real empathy. Mukesh and Rachel were also fantastic: friendly, professional, and genuinely understood my situation. I was incredibly stressed and needed expert advice. Parnell and Peel delivered exactly that. Thanks to their hard work, my case was dismissed before going to trial. Highly recommend!”
